dont forget that 5 storeys facing park road means that the taller building to the rear still has views over the parklands (higher value) and better solar access and reduced sense of enclosure for the internal open space

i have not looked into the full details of this but me thinks that quite a few schemes in the $8-9.5m range will be miraculously be $10m now

Unless the process has changed, ACC would have the power to decline to assess the application from the outset (ie refusal). There is no right of appeal against this decision by the applicant.
